General Terms and Conditions (AGB)

1. general

1.1 The following General Terms and Conditions (GTC) govern the contractual relationship between the provider “Ihr Freitodbegleiter” and the users (hereinafter referred to as “customers”).

1.2 By using the services of “Ihr Freitodbegleiter”, the customer declares his agreement with these GTC.
1.3 Deviating regulations or individual agreements require the express written consent of the provider.
2. services of the provider
2.1 “Ihr Freitodbegleiter” provides documents and information to doctors and other competent bodies who can advise or act within the framework of the legal and ethical guidelines on the implementation and care of suicide decisions.
2.2 The provider does not provide legal advice or medical treatment.
2.3 The final decision on the acceptance or rejection of documents is the sole responsibility of the mediated doctors or institutions.

3. procedure and conclusion of contract

3.1 The customer submits the required documents using the form provided on the website.
3.2 After the documents have been checked by “Ihr Freitodbegleiter”, they are forwarded to a suitable doctor or an appropriate facility.
3.3 If it is determined that the documents permit treatment or care within the scope of the services offered, a referral fee will be payable in accordance with point 4.
3.4 If it turns out that the documents are incomplete or unusable, the customer will not incur any costs.
3.5 The provider reserves the right to reject requests if they do not comply with ethical or legal requirements.

4. agency fee

4.1 The agency fee is €952 net.
4.2 The fee is due upon successful referral to the doctor or facility, regardless of whether the person concerned makes use of further care or treatment.
4.3 Payment of the fee shall be made after receipt of the invoice within the payment period stated on the invoice.
4.4 In the event of late payment, the provider is entitled to charge interest on arrears at the statutory rate and to claim further reminder fees.
4.5 In the event of cancellation after placement has already taken place, the fee remains due in full.
4.6 Should the person concerned die before actually making use of the arranged service, the agency fee shall nevertheless remain due. Payments already made will not be refunded.

5. rights and obligations of the customer

5.1 The customer is obliged to provide truthful and complete information.
5.2 The customer shall be responsible for ensuring that all documents submitted are complete and legible.
5.3 The customer agrees that the transmitted data may be passed on to third parties (e.g. doctors or institutions) insofar as this is necessary for the fulfillment of the service.
5.4 The customer undertakes to check the requirements for assisted suicide in accordance with the criteria specified on the website and to ensure that these are met.
5.5 The customer declares that the request for assisted suicide is free from external influences and pressure from third parties.
5.6 The customer undertakes to provide further evidence or documents required for the brokerage at the provider’s request.

6. liability

6.1 “Ihr Freitodbegleiter” is not liable for the decisions or actions of the doctors or institutions to whom the documents are forwarded.
6.2 Liability for indirect damages, lost profits or consequential damages is excluded, unless these are due to gross negligence or intent on the part of the provider.
6.3 The Provider shall not be liable for delays or non-performance due to force majeure.
6.4 The provider is not liable for the rejection of the application by doctors or facilities due to insufficient or incomplete documentation.
6.5 The provider assumes no liability for the legal admissibility of assisted suicide in each individual case.
6.6 Any liability of the Provider is limited to the amount of the agency fee.

7. data protection

7.1 The protection of the customer’s personal data has the highest priority. Data is processed in accordance with the General Data Protection Regulation (GDPR).
7.2 Further information on data protection can be found in the privacy policy on the website.
7.3 The customer agrees that his/her data may be passed on to third parties involved for the purpose of arranging and carrying out the assisted suicide.
7.4 The Provider undertakes to treat the Customer’s data confidentially and to use it only to the extent necessary.
7.5 The provider is not liable for data loss caused by technical faults or attacks by third parties.

8. right of withdrawal

8.1 Customers who are consumers within the meaning of Section 13 BGB have the right to withdraw from the contract within 14 days without giving reasons.
8.2 The right of withdrawal expires if the service has been started with the express consent of the customer before the expiry of the withdrawal period and the provider has informed the customer that the right of withdrawal expires upon complete fulfillment of the contract.
